Steps to Register Trademark
Online
Step 1 - Trademark Search
First, find a suitable name for your business. The brand name should be
unique, which no one has ever used before. You can also check whether your
brand name is different or not. For this purpose, you have to first go on the
website of Intellectual Property India website: http://ipindia.nic.in/trade-marks.htm.
Step 2 - File the
application Form
After finding the perfect name, fill the form to apply for a trademark.
Also, read the application form for trademark registration carefully. Fill in
the requested information. After that, select the class you want to register
your mark for.
Step 3 - Attach the
Documents
Along with the application, you also have to attach some supporting
documents to validate the use of the mark.
- Address Proof
- Power of Attorney
- PAN Card
- Aadhar Card
- MSME Certificate
- TM -48 FORM (attested)
- COI (certificate of business incorporation)
- Proof of Office Premises
- Declaration
Then, you have to submit the application fee. After which, you will get
the Acknowledgment slip and receipt.
Step 4 - Pay the
Registration Fees
After that, submit the form, and you will be redirected to the payment
gateway. The application fee is Rs. 4500 for individuals
and Rs. 9000 per application per class for business.
Trademark Checks and Status
When the application submits it passes to several checks and approvals.
- New Application - The status of the
application can be tracked by the unique registration number given to you
after registration.
- Send to Vienna Codification - Next, the trademark you have applied for is
given a unique code from the 29 classified categories. It is different
from the trademark class. The furniture trademark class is Class 20,
but the Code is assigned on the basis of your design of logo or name of
the brand and not the product category.
- Formalities Chk Pass / Fail - After that, the examiner checks
all the information and documents submitted. If there is any missing
document, they can fail the formalities chk. Therefore, to avoid this,
always hire the agent service provider for filing your trademark.
- Marked for Exam - If your application passes
the check, it is further sent for examination, and the status is "Marked for Exam".
- Exam Report Issued - After the examination,
the authorities issue the exam report. If the mark approves, objects,
reject or have any queries, it mentions in the report along with all the
details.
- Accepted/Objected - If the report is
unmistakable, the mark accepts and goes for further process. If there is a
query, the status changes to object, and the authorities ask you for a
detailed explanation.
- Advertised befAcc - In this stage, the mark is displayed to the
general public, and they can raise any objection or opposition.
- Accepted and advertised - Here, If no objection is raised within
three months from the date of publication means 90 days or, in some cases
120 days, the brand name is carried forward for acceptance. The mark is
accepted and listed in the Journal with the name of the owner and all the
details.
- Registered - You may now be permitted to use
the registered trademark next to your brand name.
Validity of Trademark
After you find your Furniture Trademark Class and register your mark,
you must be wondering about how long is it valid for.
A trademark once accepted, is valid for ten years from the date of issue
of the Certificate of Registration. After the expiry of 10 years, you need to
renew it.
